Association for Balancing Life Energy, LLC Membership Agreement
Thank you for applying to become a member of the Association for Balancing Life Energy, LLC (“ABLE”) and participating in ABLE’s program which offers members a full spectrum energy rebalancing approach designed to support the body’s natural inclination toward wellness and wholeness (“ABLE System” also known as “ABLE Program”), as well as speed the evolution of your consciousness. By becoming a member in the ABLE Program you agree to the following terms and conditions:
1. ABLE Program Theoretical Approach
You understand the ABLE Program is a spiritually based program, designed to rebalance and harmonize your complete energy system. Further, you understand there are two (2) components of the ABLE Program. The first is prayer and an innovative “prayer wheel technology” developed by ABLE designed to make it possible to amplify and appropriately direct to you aspects of life energy which may facilitate the rebalancing of all of your energy bodies, as well as speed the evolution of your consciousness (“ABLE Pathway”). Therefore, you understand the ABLE Pathway is designed as a process of energy transmission and reception between you and the ABLE Pathway, where it is designed for you to automatically receive the benefits of the transmissions. The second component for the ABLE Program is guidelines for a spiritual practice that can support you in increasing your receptivity to the energy transmissions.
ABLE believes the design and function of the “prayer wheel technology” was informed by Divine revelation, arcane historical sources, and direct experimentation, and it functions only with the cooperation of Divine will and wisdom. ABLE’s premise is your Higher Self, an aspect of the Divine that holds the awareness of your experience over lifetimes, is able to select from the pallet of energies being transmitted by the ABLE Pathway to support your highest good at any point in your evolution. Theoretically, the ABLE Program makes it possible for members to experience a greater sense of wholeness and well-being, increased awareness about specific areas of their lives, and an increase in life-affirming thoughts, feelings, beliefs, and behaviors. If you ever have questions or concerns about the nature of the theories, methods, approaches and/or techniques ABLE uses for the ABLE Program and/or the ABLE Pathway, please feel free to ask ABLE for further resources or references.
2. Membership Fee
You agree to pay a monthly membership fee (the “Fee”) in the amount of
3. Term of Membership Agreement
The term of this Membership Agreement (“Agreement”) shall commence on the date written below and continue until either party terminates this Agreement. You have the right at any time to cancel your membership and terminate this Agreement by providing ABLE with written notice of your intent to cancel your membership and terminate this Agreement. ABLE has the right to terminate your membership and this Agreement for any reason, including failure to pay the Fee, by providing you with written notice of ABLE’s intent to cancel your membership and terminate this Agreement. In addition, ABLE has the right at any time to cease offering the ABLE Program by providing you with written notice of ABLE’s decision to terminate this Agreement and cease offering the ABLE Program.
4. Member Responsibilities
Physical Element
You understand as a member, the ABLE Program requires something from you that contains your energy (“Physical Element”). You understand the Physical Element provides a representation of your whole energy similar to the way in which an acorn contains the blueprint of the energy of the entire oak tree. Further, you understand ABLE places the Physical Element in a vial on the “prayer wheel tray” and it is bathed in prayer energy designed to activate the transmission to you. Therefore, in order to activate your membership, you agree to mail to ABLE a minimum of four (4) to five (5) nail clippings free from artificial coloring or protective coatings to the following address: Association for Balancing Life Energy, LLC, 2269 Chestnut St. #327, San Francisco, California 94123, USA.
Membership Restrictions
You understand you are only permitted to apply as a member and participate in the ABLE Program for yourself, or as the parent or legal guardian of a minor or ward, or as the owner or legal guardian of an animal. You are expressly prohibited from submitting a Physical Element that is not yours or not from a minor or ward that you are the parent or legal guardian thereof, or not from an animal that you are not the owner or legal guardian thereof.
Spiritual Practice Guidelines
You understand ABLE provides members, as part of the ABLE Program, with spiritual practice guidelines designed to assist members in enhancing each member’s ability to receive the energy transmissions (“Guidelines”). The Guidelines include the six (6) steps of the spiritual practice, a surrendering process, and a healthy energy diet. You acknowledge ABLE has provided you with information regarding the Guidelines. While you are under no obligation to use the Guidelines, you understand ABLE encourages you to use the Guidelines as part of your membership.
Member Feedback Forms
In order to maintain your membership, you agree to provide ABLE with feedback about your experience with the ABLE system by phone or email. ABLE may get in touch with you by phone or email for you to provide feedback, and ABLE shall have the right to cancel your beta membership, and terminate this Agreement if you fail to submit the required feedback when contacted by ABLE. Intuitive Readings For purposes of improving the ABLE system, we may from time to time perform intuitive reading of your energy field and its interaction with the ABLE prayer transmissions. You consent to these occasional intuitive readings of your energy field. The content of the readings is not shared outside ABLE.
5. Membership Activities
As part of your ABLE membership, you have the option to participate in various membership activities, including tele-meetings where information and spiritual channeling is shared with members participating in the tele-meeting. If you elect to participate in any such membership activities this Agreement shall be in full force and effect and will govern your participation in any membership activities you voluntarily participate in. Due to the fact that membership activities include group processes in which you may reveal personal information you understand that you waive your rights of privacy and confidentiality.
6. Risk & Benefits/Outcome Expectations
You understand because the ABLE Program is a new approach to wellness and evolution through prayer and spiritual practice, the risks and benefits are unknown. Further, you understand that your progress through the ABLE Program is variable and dependent on the quality of both the prayer transmission and your receptivity. Therefore, ABLE cannot provide any guarantees or predictions regarding the outcome or the results you may experience from participating in the ABLE Program. Some of the benefits you may experience from participating in the ABLE Program include, feeling more physically energized, emotionally calm and less stressed, having a deeper spiritual connection, and an overall sense of well-being. However, please be advised by participating in the ABLE Program, it’s possible you may inadvertently experience an adverse physical and/or emotional reaction which could be perceived as a negative side effect. In addition, by participating in the ABLE Program, it’s possible to experience some emotional distress and physical discomfort, which may be related to stressful experiences you may have had earlier in life. If you experience any negative side effects or any distressing physical, mental, emotional, or spiritual reactions while participating in the ABLE Program, you agree to seek appropriate professional help.
7. Other Important Information
You understand the ABLE Program is experiential in nature, and your participation in the ABLE Program is not intended to diagnose, treat, cure, or prevent any medical condition or mental/psychological disorder. You agree to consult with your health care providers for any specific medical, emotional, or psychological problems or issues. Further, you agree to continue any medical or psychological treatments that you’re currently receiving and to not stop seeing any of your health care professionals or using prescribed medication, if any, without consulting with your health care professional, even if after participating in the ABLE Program you believe that such medication, treatment, or therapy is unnecessary.
8. Assumption of Risk
You understand that your participation in the ABLE Program is strictly voluntary, at your own risk, and that you freely choose to participate. Since the ABLE Program is experiential and the extent of the ABLE Program’s effectiveness, as well as the its risks and benefits, are not fully known, you agree to assume and accept full and complete responsibility for any and all risks associated with your participation in the ABLE Program. Further, you agree and understand that this Agreement is intended to be a complete unconditional release of liability and assumption of risk to the greatest extent permitted by law.
9. Notice
All notices required hereunder shall be in writing and shall be given either by personal delivery, email, facsimile, recognized delivery service or by registered or certified mail, and shall be deemed given hereunder on the date delivered, emailed, or a date forty-eight (48) hours after the date mailed if mailed in the United States, and five (5) business days if mailed outside of the United States, except notice of change of address which shall be effective only upon actual receipt thereof. Notices shall be sent to you to the address as set forth below, or any other address designated by you. Notices to ABLE shall be sent to the Association for Balancing Life Energy, LLC, 2269 Chestnut St. #327, San Francisco, California 94123, USA.
10. Representations and Warranties
You represent and warrant that you’re competent and able to understand the nature and consequences of participating in the ABLE Program and that you are an adult under the laws of the State of your residence and you have the right to enter into this Agreement. If you are a minor, your parent or legal guardian hereby represents and warrants that you’re competent and able to understand the nature and consequences of participating in the ABLE Program. Further, you represent and warrant that the Physical Element you submit to ABLE, in order to participate in the ABLE Program, is yours and is not from any other third party. If you are a minor, your parent or legal guardian hereby represents and warrants that the Physical Element being submitted on your behalf, in order to participate in the ABLE Program, belongs to you and is not from any other third party.
11. Miscellaneous
Any and all matters in dispute between the parties to this Agreement, whether arising from or relating to the Agreement itself, or arising from alleged extra-contractual facts prior to, during, or subsequent to the Agreement, including, without limitation, fraud, misrepresentation, negligence or any other alleged tort or violation of the contract, shall be governed by, construed, and enforced in accordance with the laws of State of California, without regard to conflicts of law doctrines and regardless of the legal theory upon which such matter is asserted. If any portion of this Agreement is held to be invalid, it is agreed that the balance of the Agreement shall continue in full force and affect. This Agreement may not be amended except in writing signed by both parties. No waiver by any party of any right under this Agreement will be construed as a waiver of any other right. If a court finds any provision of this Agreement is invalid or unenforceable as applied to any circumstance, then the remainder of this Agreement will be interpreted to best carry out the intent of the parties. By signing below, you acknowledge that you have carefully and completely read and fully understand all aspects of this Agreement and you agree to all of the terms and conditions stated herein. This Agreement shall be binding upon you and your heirs, family, legal representative, successors, and assigns.
For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, you and your heirs agree to fully release, indemnify, hold harmless, and defend, ABLE, its owners, members, principals, employees, staff members, agents, representatives, consultants, volunteers, and others associated with ABLE, from any and all claims or liability, of whatsoever kind or nature, and for any damage or injury, including but not limited to, financial, personal, emotional, psychological, medical, or otherwise, which you may incur arising at any time as a result of your voluntary decision to become a member of ABLE and participate in the ABLE Program.
